FOX SUFFERS ANOTHER LEGAL DEFEAT IN ITS ANTI-HOPPER LAWSUIT

A federal appeals court on Friday unanimously rejected Fox Broadcasting’s petition to rehear its case against Dish’s “Hopper” DVR, which allows users to skip commercials on recorded television programs automatically. In a statement, Dish’s lawyer, Stanton Dodge, said, “This is a victory for American consumers, and we are proud to have stood by their side in this important fight over the fundamental rights of consumer choice and control.” But Fox vowed to fight on, observing, “The ruling was based on a factual record from more than a year ago. Now that we have gathered more evidence, we are confident that we will ultimately prevail on all of our claims.”
